Terms of Service

By accessing or using CalyPaly ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

You must be at least 18 years old to use this Service. By using CalyPaly, you represent that you are at least 18 years of age.

CalyPaly is a scheduling platform that allows users to create booking pages, manage availability, and accept appointments from clients. The Service includes:

• Creating and managing booking types
• Setting availability and receiving bookings
• Calendar integration (Google Calendar, Microsoft Outlook, iCloud Calendar)
• Payment processing through third-party providers (Stripe, PayPal)
• Email notifications and reminders

Account Creation: You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.

Account Responsibility: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

Account Termination: We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion.

You agree NOT to use CalyPaly to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Send spam or unsolicited communications
• Attempt to gain unauthorized access to our systems
• Interfere with the Service's operation
• Collect user data without consent
• Engage in fraudulent activities

Certain CalyPaly plans include features described as "unlimited." These unlimited features are provided for reasonable, legitimate business use and are subject to this Fair Use Policy.

What "Unlimited" Means: Unlimited features are designed to remove artificial barriers for normal business operations. They are not intended for activities that place excessive burden on our infrastructure or abuse the Service.

Examples of Fair Use:

• A consultant managing hundreds of client bookings per month
• A business using the platform for multiple booking types and calendars
• Creating booking types for various services you offer
• Setting up webhooks for legitimate business integrations

Examples of Unfair Use:

• Automated or bot-driven mass creation of bookings
• Using webhooks as a proxy service unrelated to scheduling
• Sharing a single account among unrelated businesses
• Reselling access to CalyPaly features without authorization
• Any use that degrades service performance for other users

Our Rights: We reserve the right to monitor usage patterns and contact users whose activity significantly exceeds typical usage. In cases of clear abuse, we may throttle, suspend, or terminate accounts. We will make reasonable efforts to contact you before taking action, except in cases of severe abuse or security concerns.

Good Faith: We apply this policy in good faith. If you're unsure whether your intended use is acceptable, contact us at support@calypaly.com and we'll be happy to discuss it.

Free Tier: Basic features are available at no cost.

Pro Subscription: Pro features are available for $9/month or $89/year. Subscriptions renew automatically until cancelled.

Payment Processing: When you accept payments through CalyPaly, payments are processed by Stripe or PayPal. You are responsible for any fees charged by these payment processors.

Refunds: Subscription fees are non-refundable except as required by law. For booking refunds, hosts are responsible for their own refund policies.

Host Cancellations: Hosts may cancel bookings at any time. If a booking was paid, the host is responsible for issuing refunds through our platform.

Guest Cancellations: Guests may request cancellations. Refund policies are set by individual hosts.

Disputes: We are not responsible for disputes between hosts and guests. We encourage parties to resolve issues directly.

The Service and its original content, features, and functionality are owned by CalyPaly and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you create on CalyPaly (booking types, descriptions, etc.) but grant us a license to display and distribute this content as necessary to provide the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALYPALY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

These terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions.
